Welcome to Itaku Exchange. These Terms of Service ("Terms") govern your access to and use of the Itaku Exchange website, online store, products, services, and related content (collectively, the "Site").

By accessing or using the Site, creating an account, placing an order, or purchasing a product through the Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site.

1. About Itaku Exchange

Itaku Exchange operates as an online marketplace and retailer offering collectible streetwear, fashion, art, and related products. Products available through the Site may include items associated with brands, artists, designers, and collaborations such as BAPE, Supreme, KAWS, Carhartt, Anti Social Social Club, Banksy, and others.

Unless expressly stated otherwise on a particular product page, Itaku Exchange is not affiliated with, endorsed by, sponsored by, or officially connected to the brands, artists, designers, or rights holders whose products or names may appear on the Site.

All trademarks, logos, brand names, artwork, and other intellectual property remain the property of their respective owners.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make purchases through the Site.

By using the Site, you represent that you have the legal capacity to enter into these Terms and that all information you provide is accurate and complete.

If you are using the Site on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

3. Accounts

Certain features of the Site may require you to create an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

You agree to provide accurate, current, and complete information when creating or maintaining an account and to update your information when necessary.

Itaku Exchange reserves the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent, abusive, or unlawful activity.

4. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, pricing, availability, sizing information, and other product details displayed on the Site are accurate.

However, product images may vary slightly from the actual product due to photography, lighting, screen settings, manufacturing variations, or other factors.

For products that are used, pre-owned, vintage, collectible, or otherwise not brand-new, any condition information provided on the applicable product listing forms part of the product description. Customers are responsible for reviewing the listing and condition information before purchasing.

Product availability may change without notice.

We reserve the right to limit quantities, discontinue products, or refuse to sell products to any customer when reasonably necessary.

5. Authenticity

Itaku Exchange makes reasonable efforts to accurately represent the products offered for sale and to identify products appropriately.

Where applicable, authenticity is evaluated using information, documentation, physical characteristics, provenance, and other available indicators. However, no authentication process can eliminate every possibility of error.

Customers should review the product description and any available authenticity information before purchasing.

6. Pricing and Payment

All prices displayed on the Site are subject to change without notice.

We reserve the right to correct pricing, product descriptions, availability information, or other errors on the Site, including after an order has been submitted.

Submitting an order does not necessarily mean that the order has been accepted. An order may be declined, cancelled, or refunded if there is an error in pricing, availability, product information, payment authorization, or for other legitimate reasons.

You agree to provide valid and accurate payment information and authorize the applicable payment provider to charge the total amount of your purchase, including applicable taxes, shipping charges, and other disclosed fees.

7. Orders and Order Acceptance

When you place an order, you are making an offer to purchase the selected products under these Terms.

We reserve the right to accept or reject any order at our discretion, subject to applicable law.

An order confirmation or payment authorization does not guarantee that an order will ultimately be fulfilled.

If an order is cancelled after payment has been processed, the applicable amount will be refunded to the original payment method unless otherwise required or permitted by law.

8. Shipping and Delivery

Shipping options and estimated delivery times are presented during the checkout process or otherwise communicated with the applicable order.

Delivery estimates are estimates only and are not guaranteed unless expressly stated otherwise.

Itaku Exchange is not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, weather, natural disasters, customs processing, transportation disruptions, governmental actions, or other unforeseen events.

Customers are responsible for providing accurate shipping information. Itaku Exchange is not responsible for orders shipped to an incorrect or incomplete address provided by the customer.

For international orders, the customer may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.

9. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and order cancellations are subject to the applicable policy displayed on the Site or provided with the order.

Because certain products may be limited, collectible, vintage, used, or otherwise difficult to replace, some products may be subject to different return or refund conditions.

Customers should carefully review the applicable product listing and return policy before placing an order.

Any item approved for return must be returned in the condition required by the applicable return policy. Items that have been worn, altered, damaged, washed, modified, or otherwise changed from their original condition may be ineligible for a refund or exchange.

Itaku Exchange reserves the right to reject returns that do not satisfy the applicable return requirements.

Nothing in this section limits any rights that cannot legally be waived under applicable law.

10. Chargebacks and Payment Disputes

Customers agree to contact Itaku Exchange at support@itakuexchange.com to attempt to resolve legitimate billing, order, or transaction issues before initiating a payment dispute or chargeback.

Fraudulent or abusive chargebacks may result in account suspension, order cancellation, or other action permitted by law.

This provision does not prevent you from exercising rights that cannot legally be waived.

11. Prohibited Uses

You may use the Site only for lawful purposes.

You agree not to:

• Use the Site for fraudulent or unlawful purposes.

• Attempt to purchase products using stolen, unauthorized, or fraudulent payment information.

• Impersonate another person or entity.

We reserve the right to investigate suspected violations and take appropriate action.

The Site and its original content, including text, graphics, photographs, logos, designs, layout, software, and other materials, are owned by or licensed to Itaku Exchange unless otherwise indicated.

You may access and use Site content for personal, non-commercial purposes in connection with your use of the Site.

You may not reproduce, modify, distribute, sell, publish, publicly display, create derivative works from, or otherwise exploit Site content without prior written permission.

Third-party trademarks, logos, artwork, product names, and other intellectual property displayed on the Site belong to their respective owners.

Nothing in these Terms grants you ownership or licensing rights in any third-party intellectual property.

13. User Content

If the Site allows you to submit reviews, comments, photographs, feedback, or other content ("User Content"), you retain ownership of your User Content.

By submitting User Content, you grant Itaku Exchange a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, modify, and publish that User Content in connection with operating, promoting, and improving the Site and its services.

You represent that you have the rights necessary to submit the User Content and that it does not violate the rights of another person or entity or applicable law.

We reserve the right to remove User Content that we believe violates these Terms or is otherwise inappropriate.

14. Third-Party Websites and Services

The Site may contain links to third-party websites, services, payment processors, shipping providers, social media platforms, or other resources.

These third-party services are governed by their own terms and policies.

Itaku Exchange is not responsible for the content, availability, security, policies, or practices of third-party websites or services.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its content are provided on an "as is" and "as available" basis.

Itaku Exchange does not guarantee that:

• The Site will always be available or uninterrupted.

• The Site will be free from errors, defects, viruses, or other harmful components.

• Product information will always be complete or error-free.

• Product availability will remain unchanged.

• Delivery estimates will always be accurate.

• The Site will meet every user's individual requirements.

To the fullest extent permitted by law, Itaku Exchange disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded under applicable law.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Itaku Exchange and its owners, employees, affiliates, contractors, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site or purchase of products.

To the fullest extent permitted by law, our total liability arising from a particular transaction will not exceed the amount you actually paid to Itaku Exchange for the product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

17. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Itaku Exchange and its owners, employees, affiliates, contractors, service providers, and representatives from claims, liabilities, damages, losses, costs, and expenses arising out of:

• Your misuse of the Site.

• Your violation of applicable law.

• Your infringement of another person's or entity's rights.

20. Suspension or Termination

We reserve the right to suspend or terminate your access to the Site, cancel orders, or restrict transactions if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive activity, or otherwise misused the Site.

Termination does not affect provisions of these Terms that by their nature should continue after termination.

These Terms will be governed by and interpreted in accordance with the laws applicable to the jurisdiction in which Itaku Exchange operates, without regard to conflict-of-law principles, except to the extent that applicable consumer protection laws require otherwise.

Nothing in these Terms is intended to deprive you of mandatory rights or protections provided to you by the laws of your jurisdiction.

22. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

23. Entire Agreement

These Terms, together with any policies or terms expressly incorporated into them, constitute the agreement between you and Itaku Exchange regarding your use of the Site and supersede prior agreements relating to the same subject matter.
